1. Parties
This Equipment Rental Agreement ("Agreement") is entered into between No More Bottles UAE, a division of Culligan Water Solutions ("Company"), and the customer ("Renter") who completes an order through the No More Bottles e-commerce platform.
2. Equipment
The Company agrees to rent to the Renter the water dispensing equipment specified in the order confirmation. The equipment remains the sole property of the Company throughout the rental period and must be returned upon termination of this agreement.
3. Rental Term
- 2-Year Contract: 24-month minimum rental period from date of installation
- 3-Year Contract: 36-month minimum rental period from date of installation
- The contract automatically renews on a month-to-month basis after the minimum term unless cancelled
4. Rental Fees
- Monthly rental fees are as specified at the time of order and confirmed in the order confirmation email
- All fees are subject to 5% UAE VAT
- Fees are charged monthly to the Renter's registered payment card
- The Company reserves the right to adjust rental fees upon contract renewal with 30 days' written notice
5. Initial Payment
- The Renter's first month's rental is charged when the order is placed
- The card used for the initial payment is securely tokenised for ongoing monthly billing
- No security deposit is required
- Charges for damage beyond normal wear and tear, or for failure to return the equipment, may be billed to the card on file
6. Installation & Maintenance
The rental includes:
- Free delivery and professional installation
- Bi-annual filter replacements
- Annual sanitisation and servicing
- UV lamp replacements for applicable products
- Technical support and emergency repairs
The Renter must provide reasonable access to the equipment for scheduled and emergency maintenance visits.
7. Renter Responsibilities
- Use the equipment for its intended purpose only
- Maintain the equipment in a clean condition
- Not relocate, modify, or tamper with the equipment without prior written consent
- Report any malfunctions promptly to the Company
- Provide access to a suitable water connection and electrical outlet
- Not allow unauthorised persons to service or repair the equipment
8. Payment Terms
- Monthly payments are processed automatically on the billing date
- If a payment fails, up to 3 retry attempts will be made over a 9-day period
- After 3 consecutive failed payments, the rental may be suspended
- The Renter is responsible for ensuring valid payment details are maintained
- Suspended accounts may incur a reactivation fee
9. Early Termination
- Early termination is subject to an early termination fee
- The termination fee is calculated as the remaining months on the contract multiplied by a percentage of the monthly rental
- The Renter must provide 30 days' written notice of intent to terminate
- Equipment must be returned in good working condition
10. Equipment Return
Upon termination, the Renter must make the equipment available for collection by the Company within 14 days. The Company will arrange collection at a mutually convenient time. Failure to return the equipment, or returning it damaged beyond normal wear and tear, may result in additional charges billed to the card on file.
11. Limitation of Liability
The Company shall not be liable for any indirect, incidental, or consequential damages arising from the use of the equipment. The Company's total liability shall not exceed the total rental fees paid in the preceding 12 months.
12. Governing Law
This Agreement is governed by the laws of the United Arab Emirates. Any disputes shall be referred to the courts of Dubai.
